These Terms and Conditions apply to the use of the Kool Car Hire directory available on the website found at www.koolcarhire.com.au and to all products and services which may be booked or accessed via this website. In addition, the Privacy Policy applies to your use of the website.
Conditions of Booking with individuals and businesses
(a) When you book a car through our platform, you agree to become legally bound by these Terms and Conditions. You should not proceed to book a car/s until such time as you have read, understood and accepted these Terms and Conditions.
(b) You acknowledge and agree that our listed cars are not our property, but owned by individuals and businesses that are using the Kool Car Hire directory platform to market their availability and cars.
Rescheduling, Refunds & Cancellations
(a) We do not offer refunds via our platform for change of mind purchases or cancellations, this is the responsibility of the individual car owners and the person/s hiring the car. Kool Car Hire is purely a platform to connect users with owners
(d) It is the hirers responsibility to make payment and deal direct with the operator
(e) The owner or business that you are hiring the vehicle/s from may have their own terms and conditions, please refer to the owners for these terms
(f) If we need to reschedule your booking due to weather conditions, please contact the operator directly.
Prices for listings
(a) We reserve the right to change any prices from time to time without notice.
(b) Where applicable, all prices include Goods and Services Tax.
(c) We reserve the right to charge a transaction fee to recover any costs that we incur for different payment methods. Transaction fees will vary depending on the payment method used.
(d) If transaction fees apply, the transaction fee will be charged at the time of purchase of your booking.
Rights at Law
Nothing in these Terms and Conditions excludes, restricts or modifies any guarantee, right or remedy that under law cannot be excluded, modified or restricted such as your statutory consumer guarantee rights, including under Australian Consumer Law.
Information Security
(a) Notwithstanding the reasonable steps taken to keep information secure, breaches could occur.
(b) In the event of a security incident, we will promptly investigate any such breaches.
(c) Should we be required, we will notify all affected parties of any breach in accordance with the Privacy Act 1988 requirements.
Communications
(b) By listing on our website, you agree to receive email updates from us and hereby authorise us to add you to our mailing list. If you do not wish to receive these updates, make sure you check the unsubscribe option on any of our email communications.
Limitation of Liability
(a) All passengers participate in experiences at their sole risk.
(b) You and all passengers hereby release us from any loss and/or damage that you incur in relation to the booking of any vehicle listed on the Kool Car Hire directory.
Variation or Waiver of Terms and Conditions
(a) If we agree to vary or waive any of our rights under these Terms and Conditions, this will be a strict variation or waiver of the specific right only and not a variation or waiver of any other rights that we may have under these Terms and Conditions.
(b) Any variations and/or waivers must be in writing to be valid.
(c) We reserve the right to make changes to these Terms and Conditions at any time without notice.
Definitions
Unless the context requires otherwise, the following definitions apply to these Terms and Conditions:
(i) “We”, “us” or “our” means Kool Car Hire;
(ii) Australian Consumer Law means The Australian Consumer Laws as contained in Schedule 2 of the Competition and Consumer Act 2010;
(iv) gift voucher means a voucher purchased for an experience;
(v) passengers means any passenger of a vehicle;
(vi) Kool Car Hire means Kool Car Hire; and
(vii) website means “koolcarhire.com.au”.
